Planning Appeals

Planning appeals give you a way to challenge a decision you disagree with. If the Council refuses planning permission, or grants it with conditions you cannot accept, you can appeal to the Planning Inspectorate. You can also appeal if the Council does not decide your application in time.

Deadlines for planning appeals

Deadlines are short, and they depend on the type of application:

  • 12 weeks for householder applications and minor commercial applications, including shop fronts
  • eight weeks for advertisement consent
  • six months for most other applications

If the Council has served an enforcement notice for the same development, the deadline can be as short as 28 days. Always check the date on your decision notice.

How we handle planning appeals

We prepare and submit your appeal and represent you before the Planning Inspector. First, we visit the site and assess the proposal. Next, we examine the Council’s reasons for refusal. Then we advise whether an appeal is worthwhile and how likely it is to succeed.

The Planning Inspectorate decides most appeals on written representations. Some go to a hearing or an inquiry. We advise which route suits your case and prepare the evidence.

Appeal or revise your application?

Sometimes a revised application is the better route, especially if a small change would answer the Council’s concerns. We tell you which is more likely to work.

Appeals on different types of project

We handle appeals on many kinds of scheme. These include home extensions, shop fronts, advertisement consent and planning enforcement notices. For official guidance, read the GOV.UK page on how to appeal a planning decision (https://www NULL.gov NULL.uk/appeal-planning-decision).
