Discharge of Conditions
Discharge of conditions is how you get the Council’s formal approval for the details a planning condition asks for. Most planning permissions come with conditions. You must meet some before work starts. Others apply before you occupy or use the building.
What does discharge of conditions involve?
You submit an application with the details the condition asks for. Typical examples include materials, landscaping, drainage and a construction management plan. The Council checks the details and confirms in writing when it is satisfied. A single application can cover more than one condition.
Why discharge of conditions matters
Failing to discharge or comply with conditions can delay your development, lead to enforcement action and put the permission itself at risk. So it pays to deal with conditions early. If you disagree with a condition, you may be able to challenge it through planning appeals.
How Shape can help
We prepare and submit the application on your behalf. We liaise with the planning department, your architect and your contractor. Our aim is to make sure the details meet the Council’s requirements first time. If a condition is unclear, we explain what the Council wants to see.
This service suits many projects, from a single home extension to a larger new residential development.
How long does it take?
The Council normally has eight weeks to decide an application, unless you agree a longer period. So it is worth starting early. A fee is payable to the Council. Check the current fee before you apply. For national guidance, read the GOV.UK guidance on planning conditions (https://www NULL.gov NULL.uk/guidance/use-of-planning-conditions).
Tell us about your conditions
Send us your decision notice and a short description of the project. We can tell you which conditions you need to discharge and what to do next.
