- Change of UseLand and buildings in the UK are categorised into a number of different use classes depending on what activities are carried out in the land or buildings. These use classes are defined by law and include use classes such as A1 Shops, A3 Restaurants and cafés, B1 Business and C3 Dwellinghouses. Changes between uses normally require a planning application to be submitted to gain planning permission, however some changes are permitted without submitting a planning application. Changes within the same use class do not require planning permission for example the change of a book shop to a shoe shop, in addition there are certain changes between class that also do not need planning permission, such as a change from A3 Restaurants and cafés to A1 Shops. In all cases planning permission is required for a new shop front or certain alterations to existing shop fronts, such as installing security shutters. Furthermore, if you are thinking of altering a shop front that is part of a listed building, then you will also need listed building consent. A Certificate of Lawfulness (also known as Lawful Development Certificate, LDC, CLOPUD, CLEUD, or just a Certificate) simply provides clarification from the Local Planning Authority whether a use or development of property or land is, or would be considered lawful.

There are two types of Certificates of Lawfulness:

Certificate of Lawfulness of existing use or development
Certificate of Lawfulness of proposed use or development.

A Certificate of Lawfulness of existing use or development allows a person to ascertain whether any use or development is lawful.

A Certificate of Lawfulness of proposed use or development can be applied for when a person wishes to ascertain whether any proposed development would be lawful.
